Legislation

  • HB1099, by Rep. Wallace Collins, D-Norman, increases the penalty for assault and battery on emergency medical care providers who are performing medical care duties. It increases the offense from a misdemeanor to a felony, punishable by imprisonment in the Department of Corrections for up to two years.
  • HB1360, by Rep. Marian Cooksey, R-Edmond, increases from a misdemeanor to a felony assault or battery on an emergency medical care provider, and increases the penalties to custody with the Department of Corrections for a minimum of two years.
  • SB0955, by Sen. John Sparks, D-Norman, increases from a misdemeanor to a felony the crime of assault or assault and battery on an emergency medical care provider who is performing medical care duties and increases penalties to up to two years imprisonment with the Department of Corrections and/or a maximum $2,000 fine
  • SB1087, Remove duties of EMS from the OSDH and place them under an EMS Board.
  • HB1494, by Rep. Wallace Collins, D-Norman, $400.00 Tax Credit to all EMTs that work 1000 hours a year for an Ambulance Service.
  • HB1537, by Rep. Corey Holland, R-Marlow, creates a tax credit not to exceed $250 for anyone in Oklahoma employed as a law enforcement agent, a firefighter or an emergency medical technician for necessary materials purchased exclusively for their duties.
  • HB1542, by Rep. Corey Holland, R-Marlow, creates the Rural Emergency Medical Services Assistance Act of 2009.

  • HB1888, SB931, HB1359 The Rural Ambulance Service Act is also known as Title 19, sets up Ambulance Districts and funding for that District. It would allow any county to use the act to set up an Ambulance Districts. It also says by November 1, 2010, each county of this state shall present to the Legislature and Governor an emergency medical services coverage plan.  The plan shall:

    A. address funding issues and any gaps in emergency medical service coverage,

    B. address county boundaries to ensure 9-1-1 operators are able to provide quick response, and

    C. has been presented to county citizens for public comment.

  • If a county does not provide a plan in accordance with this section, then a licensed ambulance service shall no longer have a duty to act as required by law. It also says that counties can use any type of funding for the District, not just property tax, they can use other ideas like Oklahoma City and Tulsa has passed. It also rewrites Duty to Act and reads as follows:

    A.  There is a required duty to act upon the acceptance of an ambulance service license.  All licensed ambulance services shall respond when called for an emergency within the primary service area of the ambulance, as defined by the description and map submitted with the most recent license application or renewal.  The ambulance service shall respond regardless of the ability to pay of the patient. 

    B.  If the ambulance service cannot physically respond within the limits of the Ambulance Service Districts Act, then the ambulance service called shall immediately call for mutual aid from a neighboring licensed ambulance service.  Nonemergency, interfacility transfers are exempt from the requirements of this subsection.

    SECTION 1.  This act shall become effective <November 1, 2009>.

         HB1359 also rewrites the Duty to Act.

    SECTION 1.     NEW LAW     A new section of law not to be codified in the Oklahoma Statutes reads as follows:

    This act shall be known and may be cited as the “Rural Ambulance Service Stability Act”.

    SECTION 2.     NEW LAW     A new section of law to be codified in the Oklahoma Statutes as Section 1222 of Title 19, unless there is created a duplication in numbering, reads as follows:

  • Notwithstanding any administrative rule to the contrary, a licensed ambulance service shall not have a “duty to act” outside its medical service region or service area absent a written mutual aid or other prearranged agreement.

  • SECTION 3.  This act shall become effective November 1, 2009. 
  • HJR1031, by Rep. Paul D. Roan, D-Tishomingo,would make the cap six mills.    SJR0016, by Sen. Charles Wyrick, D-Fairland, proposes a constitutional amendment modifying the determination of boundaries for the purposes of forming an ambulance service district. It also removes language instituting a three mill maximum tax levy.
  • SB0992, by Sen. John Sparks, D-Norman, modifies language describing persons "qualified" in the use of an automated external defibrillator for purposes of granting civil liability immunity. It also removes language limiting immunity granted entities and persons who own or lease an automated external defibrillator.

  • SB1023, by Sen. Jonathan Nichols, R-Norman, modifies language related to emergency medical technicians.

  • SB0513, by Sen. Bryce Marlatt, R-Woodward, removes expenditures related to assessment activities, stabilization and development of risk emergency medical services and training for emergency medical directors as qualified expenditures of the Oklahoma Emergency Response Systems Stabilization and Improvement Revolving Fund.
  • SB0931, by Sen. John Sparks, D-Norman, modifies the Rural Ambulance Service Districts Act to become the Ambulance Service Districts Act, removing reference to "rural resident" and "rural area." It states that when a public ambulance service district is totally within the municipal limits of a city, the board of directors of the district are to be the governing body of the city or town. The bill requires every county in the state to submit to the Legislature and the governor by Nov. 1, 2010, an emergency medical services coverage plan. It allows counties and incorporated towns to raise revenue in any manner allowed by law, including a levy of taxes, fees or assessments on property, to cover the cost of the service district. The measure creates a required duty to act upon acceptance of an ambulance service license. It requires all licensed ambulance services to respond when called for an emergency within the primary service area of the ambulance, regardless of the patient's ability to pay. If the ambulance service cannot respond, the bill requires that it call for mutual aid.
  • SB0942, by Sen. John Sparks, D-Norman, modifies language related to the Emergency Medical Technician Death Benefit Revolving Fund.
  • SB0944, by Sen. John Sparks, D-Norman, directs the Oklahoma Tax Commission to deposit revenue from the sale of the emergency medical technician license plate to the Emergency Medical Technician Death Benefit Revolving Fund

  • SB0958, by Sen. Susan Paddack, D-Ada, allows funds from the Trauma Care Assistance Revolving Fund to be used for data collection and analysis related to emergency medical conditions such as stroke and cardiac events
